DUCSU polls: SC chamber judge extends stay on HC order

The Appellate Division of the Supreme Court (SC) has extended until Wednesday its earlier order that halted a High Court (HC) directive, suspending the Dhaka University Central Students’ Union (DUCSU) election until October 30.

Justice Farah Mahbub, Chamber Judge of the Appellate Division, passed the order on Tuesday following a petition filed by the Dhaka University (DU) authorities, seeking a stay on the HC order. The chamber judge also sent the petition, filed by the DU vice-chancellor, to its regular bench for detail hearing on Wednesday (today).

Advocate Shishir Manir, who represented the DU during the court proceedings, said the matter would come as item number-one on the Wednesday’s cause-list of the Appellate Division.

Following a writ petition, the HC on Monday stayed the DUCSU election process and final voter list until October 30. The petition was filed challenging the legality of S M Farhad’s candidacy for general secretary (GS) post in the election from the Islami Chhatra Shibir-backed panel.

The HC also directed writ petitioner B M Fahmida Alam, liberation war and democratic movement affairs secretary candidate from the left alliance panel, to file a complaint with the DU’s election tribunal regarding her grievance within 15 days. It also ordered the tribunal to dispose of the complaint and submit a report to the court by October 21.

The HC also issued a rule, questioning the legality of the DU’s action to allow S M Farhad to contest the election. However, within an hour, Chamber Judge of the Appellate Division halted the HC order on Monday, giving the election a new life.
